On behalf of myself, I agree to waive, release, indemnify and hold harmless the Cardiff 101 Main Street Association and the City of Encinitas and its officers, agents, and employees from and against any and all claims, costs of liabilities, expenses, or judgments, including attorney's fees and court costs arising out of my participation in this event and any illness, allergic reaction, food allergy or injury resulting therefrom except injury deliberately or willfully caused.

I recognize that the event can be dangerous to me and accept those dangers. I understand that if I am injured, this waiver will be used against me and anyone else claiming damages because of my injury in any legal action. I also understand that this waiver cannot be modified or changed.

I acknowledge that volunteers for the event I am attending may not have reliable knowledge about the contents on the food I choose to consume on this night. I understand that I am responsible for the food and beverages I consume. In the case of an allergic reaction, I will not hold Cardiff 101 Main Street, the participating restaurants, nor the City of Encinitas responsible for any damages or injuries, or costs associated with legal action.

When you participate or attend Cardiff 101 Main Street events, you enter an area where photography, audio, and video recording may occur. By entering the event premises, you consent to interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, webcasts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by Cardiff 101 Main Street and its affiliates and representatives. Images, photos, and/or videos may be used to promote similar Cardiff 101 Main Street events in the future, highlight the event and exhibit the capabilities of Cardiff 101. You release Cardiff 101, its employees, volunteers, members, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video, and/or sound recordings.

By entering the event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, webcasting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, webcasting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recording taken by Cardiff 101 Main Street or the person or entity designated to do so by Cardiff 101 Main Street.

You have been fully informed of your consent, waiver of liability, and release before entering the event(s).
